This Privacy Policy describes how we collect, use, process, and disclose your information when you use our mobile application, website, and AI-driven concierge services. By registering an account or listing a property on DaleyDai, you consent to the collection and use of your data as detailed in this policy.

2. Information We Collect

We collect information that is necessary to verify listings, facilitate room/flat searches, and enable secure communication and transaction matching.

  • Personal Details: Full name, phone number (which serves as the primary verification token in Nepal), email address, and profile pictures.
  • Government-issued Identity Documents (KYC): For property owners and verified renters, we collect copies of your Citizenship Certificate (Nagarikta), National Identity Card, or Passport.
  • Land Ownership Details (Lalpurja): For Landlords to verify their listing's legitimacy, we collect copies or photos of the Land Ownership Certificate (Lalpurja) and tax clearance receipts.
  • Precise Location Data: We collect real-time GPS coordinates when you perform the "1-Tap GPS Check" to confirm a flat's coordinates. This is collected only when the user is actively using this feature.
  • Payment Information: Transaction receipts, transaction IDs, and associated details when paying or receiving the earnest money advance ("Baina") via eSewa, Khalti, or bank transfers.
  • AI Chat Conversations: Logs of chats between you and DaleyDai's AI Concierge, as well as bhadawal-landlord chat negotiations.

3. How We Use Information

We process your data for the following essential purposes under legal and operational frameworks:

  1. Coordinate Verification: To map and verify that listed rooms, flats, or commercial spaces are physically located at the exact coordinates submitted on our search map.
  2. Anti-Spam & Listing Legitimacy: Verifying Lalpurja data against the listed property to ensure that tenants are protected from fraudulent rental posts.
  3. AI Concierge Recommendations: Utilizing chat inputs to help Bhadawals find listings that match their exact requirements (budget, preferred bhadawal rules, water availability).
  4. Secure Payment Management: Tracking transaction details of the Baina advance to mediate payouts, refunds, and verify compliance with Nepal Rastra Bank payment rules.
  5. SMS Alerts & Notifications: Dispatching real-time notifications about match updates, chat requests, and verification statuses.

4. Sharing and Disclosure

We respect your privacy and do not sell your personal data. Your information is shared only under these conditions:

  • Match Information: Once a chat session is successfully unlocked, the matching Bhadawal and Landlord will have access to each other's primary phone numbers to coordinate physical viewings.
  • Mediation of Baina: In the event of a transaction dispute, coordinates and transaction logs may be shared with the involved parties and third-party payment gateways (e.g., eSewa, Khalti) to trace and settle payouts.
  • Legal Requirements: We will disclose information to law enforcement or judicial authorities of Nepal (such as the Nepal Police or Kathmandu District Court) if requested under official investigation procedures or the Electronic Transactions Act, 2063.

5. Verification Data

Lalpurja & GPS Verification Disclaimer The upload of Lalpurja (Land Ownership Certificate) and the execution of the 1-Tap GPS coordinate check are mandatory security gates. DaleyDai uses this data solely to audit listing integrity. The Lalpurja document itself is stored in an encrypted private storage bucket and is never displayed publicly to other users.

6. Data Security & Storage

Your data is stored securely using industry-standard cloud database structures with transit and rest encryption. Access to critical documents like Citizenship certificates and Lalpurjas is strictly gated and restricted to authorized security personnel of DaleyDai.com. While we take maximum precautions, no data transmission over the internet in Nepal can be guaranteed to be 100% secure.

7. Your Legal Rights (Nepal)

Under Chapter 3 of the Individual Privacy Act, 2075 of Nepal, you possess the following rights regarding your personal information:

  • Right to Correction: Request correction of any inaccurate or outdated information in your profile.
  • Right to Deletion: Request the deletion of your account and related KYC documents (unless data retention is legally required to resolve pending Baina payment disputes).
  • Right to Withdraw Consent: You may withdraw your consent for location mapping or notifications at any time by updating your device settings or contacting our support.
