1. Service Scope
Welcome to DaleyDai.com ("Platform"). These Terms and Conditions ("Terms") govern your access to and use of our mobile application, website, and matching platform. DaleyDai.com is an AI-driven rental concierge system that facilitates direct contact between tenants ("Bhadawals") and landlords ("Owners") in Nepal.
By using the Platform, you acknowledge that DaleyDai.com is not a real estate broker, agency, or landlord representative. We provide listing verification, AI-powered matchmaking, and secure booking escrow, but we do not own, manage, or legally lease the properties listed on the Platform.
2. User Roles & Accounts
Users can sign up and switch between two primary roles within their settings:
- Bhadawal (Tenant): Accesses search tools, chats with the AI Concierge, requests verified coordinates, and submits Baina advances to lock listings.
- Landlord (Owner): Publishes room, flat, or apartment listings, uploads ownership documents, executes GPS verification checks, and accepts booking advances.
You agree to provide true, accurate, and current profile and KYC information, including verifying your primary mobile phone number which acts as the legal transaction handle in Nepal.
3. Coordinate & Owner Verification
To ensure high integrity on the Platform, DaleyDai.com enforces mandatory listing validation rules:
- 1-Tap GPS Verification: Landlords must stand physically inside or directly next to the flat when performing the 1-tap coordinate check. Artificially spoofing coordinates or submitting check-ins from remote locations will result in listing removal.
- Ownership Documentation (Lalpurja): Landlords must upload a clear photo of the Land Ownership Certificate (Lalpurja) corresponding to the listing. The name on the Lalpurja must match the verified user profile, or the landlord must provide valid authorization (e.g., family relationship or power of attorney).
4. Baina Escrow & Refunds
To lock a property and remove it from active search listings, Bhadawals pay an earnest money advance ("Baina") through the Platform. DaleyDai.com holds the Baina securely in an escrow-like account until a physical viewing takes place or a formal lease is agreed upon.
- Non-Refundable: The Baina is non-refundable if the Bhadawal decides not to rent the property due to personal changes of mind after locking it. In this case, the Baina is disbursed to the Landlord as compensation for taking the listing off the market.
- Fully Refundable: The Baina is 100% refundable to the Bhadawal if the Landlord misrepresented the property, including but not limited to:
- Incorrect GPS coordinates (verified flat is not at the mapped location).
- Falsified Lalpurja ownership or unauthorized listing.
- The flat/room is already occupied or unavailable on the agreed move-in date.
- Key amenities listed (e.g. water source, parking space) do not exist.
DaleyDai.com will investigate coordinate logs, chat records, and verification statuses to make a binding final decision regarding Baina disputes.
5. Digital Payment Compliance
All digital payments, including Baina deposits, must be made using licensed Payment Service Providers (PSPs) in Nepal, such as eSewa, Khalti, or direct bank transfer integrations. All transactions are subject to the transaction limits, KYC requirements, and anti-money laundering (AML) guidelines set by **Nepal Rastra Bank**.
6. Prohibited Practices
Users are strictly prohibited from engaging in the following behaviors. Violation will lead to immediate account suspension:
- Posting duplicate listings with different prices to manipulate the rental market.
- Circumventing DaleyDai's chat gating limits or requesting payments outside the platform's escrow system to avoid transaction safety measures.
- Conducting calls or harassment prior to building a mutual chat session (which serves as spam protection for homeowners).
- Uploading illegal, offensive, or fraudulent property listings.
7. Limitation of Liability
DaleyDai.com provides matching and verification algorithms but is not responsible for:
- Any physical disputes, verbal/physical abuse, or safety issues arising during offline viewings or tenancies.
- The physical condition of the rental flats or any damage caused to the landlord's property by tenants.
- Loss of personal items or non-compliance with local lease agreements between Landlords and Bhadawals.
8. Disputes & Governing Law
These Terms shall be governed by, construed, and enforced in accordance with the laws of Nepal, specifically the Muluki Dewani Samhita, 2074 (Civil Code of Nepal). Any disputes arising between the user and DaleyDai.com that cannot be resolved through mutual mediation shall be subject to the exclusive jurisdiction of the Kathmandu District Court, Kathmandu, Nepal.
